1. Who can use Darc

You must be at least 18 years old and live in the United States. You need to give accurate information when you sign up and keep your sign-in details to yourself. You're responsible for activity on your account. If you think someone else has used it, email admin@darcfinance.com right away.

2. What Darc is, and isn't

Darc helps you plan your money by the week, using information from the accounts you link and what you tell it. Darc is free.

Darc is not financial advice. Darc is not a bank, lender, broker, investment adviser, tax adviser or law firm, and it doesn't act as your fiduciary. Your weekly number, plans, projections and Darc AI's replies are general information based on your own data, and they can be wrong or out of date. They aren't a recommendation to buy, sell, borrow or pay anything. You decide what to do with your money. For advice about your situation, talk to a qualified professional.

Darc depends on the data your bank sends. If a transaction is late, missing or wrong, your number will be too. Check your bank before you rely on a number for an important payment.

3. Bank connections and Plaid

Darc uses Plaid Inc. to connect to your bank. When you link an account, you authorize Plaid to get your account and transaction information from your bank and share it with Darc, under Plaid's own terms and its End User Privacy Policy. Darc never sees or stores your bank login, and Darc can't move money, make payments or transfer funds. You can disconnect a bank at any time in the app. We aren't responsible for your bank's or Plaid's services.

4. Darc AI

Darc AI answers questions and can suggest changes to your plan. It never changes your plan unless you confirm. Its replies are generated by AI, can be inaccurate, and aren't financial advice. How Darc AI works.

5. Using Darc fairly

Please don't:

• use someone else's accounts or link accounts you aren't allowed to access;
• break the law or use Darc for fraud;
• try to get into parts of Darc you aren't meant to, disrupt it, or overload it;
• copy, resell or reverse-engineer Darc, or scrape it with automated tools;
• use Darc AI to produce harmful or illegal content.

6. Ownership

Your data stays yours. You give us permission to use it only to run Darc for you, as described in the Privacy Policy. Darc itself, including its software, design and name, belongs to us. We give you a personal, non-transferable license to use Darc for your own non-commercial purposes while you follow these terms.

7. Changes to Darc and to these terms

We may add, change or remove features. If we ever charge for Darc or part of it, we'll tell you first, and you won't be charged unless you choose to pay. If we make a meaningful change to these terms, we'll update the date above and let you know in the app or by email before it takes effect. If you keep using Darc after that, the new terms apply.

8. Ending your account

You can delete your account at any time in the app (Profile → Account → Delete Account). See what gets deleted. We may suspend or close an account that breaks these terms, puts other people or Darc at risk, or that we're required to close by law. Where we reasonably can, we'll tell you why first. Sections 6, 9, 10 and 11 continue after your account ends.

9. Disclaimers

Darc is provided "as is" and "as available". To the extent the law allows, we don't promise that Darc will always be available, error-free or accurate, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

10. Limits on liability

To the extent the law allows, Darc isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost money, overdraft fees, late fees or lost data, arising from your use of Darc. Our total liability for any claim about Darc is limited to the greater of what you paid us in the 12 months before the claim or $100. Some places don't allow these limits, so they may not all apply to you.

11. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Florida, unless the law where you live says otherwise.

12. If you got Darc from Apple's App Store

These terms are between you and Darc, not Apple. Apple isn't responsible for Darc or its content, has no obligation to provide maintenance or support for it, and isn't responsible for any claims about it, including product liability, legal compliance or intellectual property claims. If Darc fails to meet an applicable warranty, you can tell Apple and Apple will refund any price you paid for the app; Apple has no other warranty obligation. You confirm you aren't in a country under a U.S. government embargo and aren't on a U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
